NCJW Alarmed by Supreme Court Decision Limiting the Nationwide Injunction Capacity of Federal Courts

WASHINGTON, DC — Today, the Supreme Court of the United States issued its opinion in Trump v. CASA, Inc., calling into question the ability of federal courts to issue nationwide injunctions to block government actions. In response, Darcy Hirsh, senior director of government relations and advocacy at National Council of Jewish Women (NCJW) — one of the nation’s leading Jewish feminist civil rights organizations, representing 250,000 advocates from across the country — issued the following statement:
“Today’s Supreme Court opinion in Trump v. CASA, Inc. is a stunning betrayal of our constitutional system. By claiming that federal courts lack authority to broadly restrain unlawful actions, the Court has effectively carved out an exception to the rule of law for the Executive Branch. This decision flies in the face of centuries of precedent that affirmed that the courts are not only empowered, but obligated to check executive overreach. The judiciary governs everyone, not everyone except the president. By stripping courts of their ability to block implementation of policies universally across the country, the Court has made it harder to protect the rights of everyone.
“Our democracy depends on a judiciary that protects rights equally, not erodes them. Make no mistake: this decision will result in chaos in our federal courts around the country by forcing each party with a claim to bring separate lawsuits in separate courts, swamping the courts with potentially thousands of cases on the same legal issue that may have differing outcomes.
“For more than three decades, National Council of Jewish Women has led the fight to ensure our courts work for the people, championing the appointment of fair, impartial, and qualified judges to our federal courts who reflect the diversity and dignity of our communities and who are committed to upholding the rule of law. NCJW’s 250,000 advocates across the country will continue to mobilize to defend the integrity of our courts and ensure they serve the public good — not political agendas.”
